Understanding OSHA Citations: Lessons from the Branson Water Main Fatality
The OSHA inspection and citation have been completed for the fatality that occurred in Branson on August 21st.
If you are unaware of this incident, let me brief you quickly. A water main broke in downtown Branson, where construction was taking place. One employee was injured, and another employee went to save him and tragically lost his life.
As with any major incident, OSHA came in to investigate.
While there are a lot of opinions and different thoughts I could write about – I want to be respectful of the company, the families involved, and our community. No matter the root cause of the incident, our job is simply to care for all parties, hold those responsible accountable, and grow from it.
Therefore, I want to walk through how to properly read this Violation Detail (found on OSHA website) so there isn’t confusion of what it means.
1. Inspection Number; a number assigned to the inspection that took place. In the OSHA system, they have all the evidence, logs, and so on listed under this number.
2. Issuance Date; the date that OSHA sent the citation (the document that outlines all the violations, expectations, penalties, and sets a deadline for correcting hazards) to the employers.
3. Report ID; the number identifying the OSHA organization who completed the inspections.
4. Citation; the number assigned to the specific violation detail.
5. Number of Instances; how many times this incident occurred. The reason this exists is that employers can have multiple incidents before OSHA comes in to investigate.
6. Contest Date; This is the day that the employer refuted the citation.
7. Citation Type; there are different types of citated incidents within OSHA (Willful, Repeat, Serious, Other, or Unclassified). This one is labeled “other” which means;
“Other-than-Serious Violations.
This type of violation shall be cited in situations where the accident/incident or illness that would be most likely to result from a hazardous condition would probably not cause death or serious physical harm, but would have a direct and immediate relationship to the safety and health of employees.” https://www.osha.gov/fom/chapter-4#:~:text=Other%2Dthan%2DSerious%20Violations.,safety%20and%20health%20of%20employees.
8. Number Exposed; shows how many employees were involved in the incident.
9. Final Order; gives the date for legal finality of the investigation.
10. Abatement Status; where the employer is in correcting the violations listed in the citation.
11. Abatement Date; The date of which the current status was updated.
12. Related Event Code; there are different types of event codes (related complaint, accident, referral, or another inspection). The event code R means a related complaint.

14. Emphasis; this is shown when it is part of strategic inspections, not related to an incident.
15. Penalty and Failure to Abate Event History; this outlines the penalties given to the employer from OSHA, the dates, cost, due date, citations, and so on. It takes the above information and puts it into a timeline.
16. Text for Citation; gives a summary of the citation, key details of the incident, and hazards that were the cause.
